Steps to Hiring a Foreign Live In Caregiver – Canadian Caregivers® makes it easy

Having a Nanny or live-in caregiver can be a rich and rewarding experience for the family, the cared for recipients and the caregivers themselves. But, often times, families and caregivers not aware of all the rules, regulations, employment standards and legislation governing employers and caregivers alike, when having to hire a Foreign Worker, whether they are already in Canada or overseas.

Canadian Caregivers® makes it easier. We take the time to make families and caregivers aware of the basics. As well, and by law, we engage Regulated Canadian Immigration Consultants (RCIC’s) to scrutinize and ensure that “Applications to Hire Foreign Live‐In Caregivers” are filed accurately and timely on behalf of families to Service Canada for approvals and Labour Market Impact Assessments (LMIA’s) as a step towards a Foreign Worker applying for a Work Permit to work with designated families.

In addition, we are a “relationship‐based” company. While we do have robust software automation, we still count on good old, one‐on‐one contacts with both candidates and employers to ensure that we get it right the first time, understand everyone’s expectations and work to find the most perfect matches.

Having said that, here are the main steps and time lines in using Canadian Caregivers® as your agency of record;
  1. Family Profile (1-2 days) and send Candidate BIO’s (1 day to 3 weeks**)
  • Employer gives permission for Canadian Caregivers® to advertise generically
  • Employer acknowledges process, costs and agreement to sign contract (Deposit Required)
  1. Employer Applies for Revenue Canada Payroll Number (if not done yet – takes 10 Days)
  1. Advertising Process (takes up to 5 weeks)
  • Client assigns Canadian Caregivers® permission to advertise on behalf of client or Employer gets guidance to do on own
  • Register with the JOB BANK (as applicable)
  • Canadian Caregivers® posts to other job boards
  • Set‐up and post Advertisement/s (30 day minimum to 120 days or more)
  • Take phone calls
  • Screen, interview and track Candidates
  • Record results on Advertisement Record
  • Print proof of advertising
  1. Interview Process (about 1 to 6 weeks)
  • Interview candidates at home or by conference call
  • Client decides whether to give a Job Offer or not
  1. Candidate Selection
  • Conditional Job Offer to Selected Candidate (Progress Payment required)
  1. If Foreign worker given a Job Offer, employer submits “Application to Hire a Foreign Caregiver” to Service Canada for a Labour Market Impact Assessment (8 – 12  weeks)
  • Appointment of Representative (e.g. authorized Immigration Consultant/Lawyer)
  • Proof of Identity (Attestation by approved community member)
  • Copy of Advertisements
  • Declaration of Posted AD Results
  • Application to Hire a Foreign Caregiver to Service Canada
  • Formal Job Offer
  • Power of Attorney (if required)
  • Proof of Employer Income, Proof of Disability, Proof of Age (e.g. birth certificates)
  • Declaration of Need for a Caregiver
  • Declaration and Room Description
  • Proof of compliance with past caregiver employees (if applicable)
  1. LMIA Approval, or Caregiver Enters Employers Home to work or as a Guest (Balance of Placement Fees Due)
  1. Caregiver Applies for Work Permit (75 days in Canada and 6 to 18 months outside of Canada – Depending on Country)
  • Employer supplies copy of Positive Labour Market Impact Assessment (LMIA) to caregiver
  • Caregiver submits copy of signed JOB OFFER of employer
  • Caregiver pays Work Permit Application FEE and submits same
  1. WORK PERMIT ARRIVES (only issued in Canada)
  • Visa clearance issued overseas for caregiver to travel to Canada
  • Caregiver usually gives one months notice to current employer (if applicable)
  • Caregiver interviewed at Border when arriving to Canada, Employer confirmation required in order to be granted a Work Permit
  • Caregiver legally permitted to work with Family with Work Permit with stated Employers Name
  • Employer pays full “return” transportation costs from caregivers address to employers address (in Canada or from overseas)
  • Employer pays for personal health care for first 90 days while waiting for Provincial Health Care to activate
  • Before beginning work, Caregiver required to register for SIN Number (Social Insurance Number)
  • Register caregiver with TD1 Federal and Provincial Schedules
  • Start Payroll routine
  • Employers Registers and pays for Worker Safety Insurance for caregiver
  • Employer / Canadian Caregivers® / Employer review Contract, ESA (Employment Standards Act) as it relates to Employer Obligations and Employee Rights (e.g. hours and limitations, overtime pay, Statutory Holidays)
  1. CONGRATULATIONS!
  • Employer to submit copy of Work Permit to Canadian Caregivers® for Replacement Caregiver period to begin (as per contract), otherwise the date is effective on the date the LMIA Application was submitted.
  • Employer gets unlimited assistance and information regarding; Payroll processing, WSIB registration, Employment Standards Act.
  • Employer and caregiver get Intermediary Services (e.g. Conflict Resolution, worker/employer rights and obligations) for Replacement Caregiver period (as per contract).
